A prosecutor’s comments during summation in a robbery trial that testimony from the sole witness had the “ring of truth” and was “truthful” represented improper vouching for the witness’s veracity, an appeals court decided in ordering a new trial.

The Appellate Division, Fourth Department, found in People v. Griffin, 10-02154, that the prosecutor’s statements were only the most “egregious” in a series of inappropriate comments and questions that prejudiced Darrell Griffin during his 2010 trial before Monroe County Court Judge Joan Kohout.
