Justices Christine Clark, Eugene Devine and Michael Lynch (Tim Roske)
Justices Christine Clark of Schenectady, Eugene Devine of Albany and Michael Lynch of Albany were sworn in as the newest members of the Appellate Division, Third Department, by Presiding Justice Karen Peters Thursday.
The court, which has struggled with a 40 percent vacancy for several months and has been shorthanded for more than two years, remains two judges shy of its 12-seat bench. Peters said this was the first time that three judges were installed at the same time.
With the appointments of Lynch and Devine, half of the court is comprised of judges from Albany, the largest of the 28 counties in the department. Clark is the first justice from Schenectady since Howard Levine left the panel in 1993 to go to the Court of Appeals. The Third remains the only Appellate Division department without any minority representation.
