An appellate panel in Rochester has denied a Syracuse law firm summary judgment in a legal malpractice action in which the firm is accused of neglecting to advise a client to notify its insurance carriers, even though the client was contractually obligated to provide the notice.

The case before the Appellate Division, Fourth Department, involves Hiscock & Barclay and its representation of Utica Cutlery Co. in a trade infringement case. Utica Cutlery sued Hiscock & Barclay for malpractice, alleging the firm did not advise it to promptly notify its insurer.
