A unanimous Appellate Division, First Department, panel on Tuesday accepted the resignation of Andrew M. Jacobs, who is under investigation by the Departmental Disciplinary Committee for misusing client funds and neglecting client matters.

In a June 28 affidavit, Jacobs said he was submitting his resignation voluntarily and without coercion. He said that if the committee brought charges against him based on its investigation, he would not be able to defend himself on the merits.
