Plaintiffs sought, among other things, a declaration that they are entitled to coverage pursuant to various insurance policies issued to them by the defendants, that they are entitled to recover the cost of defending themselves in an underlying action, and that they are entitled to recover the amount that they paid to settle that action. The underlying action involved allegations against the plaintiffs of sexual assault, hostile work environment and discrimination. The court held that defendant insurers are entitled to entry of judgment declaring that they have no obligation to afford coverage, defend or indemnify the plaintiffs in the underlying action. The court noted that it has been held that public policy precludes a party from obtaining insurance against intentional torts and the punitive liability that may arise from them. The court added that the insurers established their prima facie entitlement to summary judgment.
