Electronic Creations Corp. (ECC), an Internet development company and the owner of copyright-protected websites, brought a copyright infringement action against Gigahertz Inc., a website design and hosting company run by codefendant Brown. ECC requested a permanent injunction enjoining defendants from copying the protected works, using any copy of the protected works, or engaging in other activity constituting unfair competition. The court granted ECC's motion, finding that it established that the defendants infringed upon its copyright and trademarks on several instances by copying, altering, and republishing the existing websites located on the Internet. The court added that this supports the inference that, without a permanent injunction, the defendants will continue their illegal conduct. The court further added that the republishing of the copied websites harms the status and value of ECC's copyrights and future business prospects.
