ALBANY – A shopping mall that had a single security guard to keep watch over 85 stores on a 72-acre site cannot be held civilly liable for a shooting rampage because the crime was not reasonably foreseeable, the Appellate Division, Third Department, held on Thursday.

While the justices agreed that the Hudson Valley Mall in Kingston is not liable to the victims of Robert Bonelli Jr., a concurring judge, who is based in Kingston, castigated the mall’s owners for their "frighteningly inadequate" attention to security.
