United Central Bank was granted summary judgment in its mortgage foreclosure claim. A magistrate judge’s March 4 report recommended that it be awarded judgment exceeding $11.9 million, plus per diem interest accruing from Feb. 13 until the date of judgment’s entry. Except as to legal fees, the court adopted the magistrate judge’s report, and ordered that United Central Bank be awarded judgment in the amount of $11,926,852.46 plus interest on the two loans’ outstanding principal at per diem rates of $2,374.74 and $31.46, respectively. Noting the bank’s objection and submissions challenging the magistrate judge’s rejection of its request for $24,688 in unpaid legal fees, the court declined to consider the bank’s new evidence and determined that the magistrate judge correctly found the bank not entitled to attorney fees incurred but not yet paid. The court further found the bank not entitled to $6,168 in legal fees and costs already paid. Noting the award’s basis on an uncorroborated, independently generated spreadsheet submitted by the bank, the court’s discomfort was heightened by the bank’s failure to provide billing records and information supporting spreadsheet entries, from which a reasonable fee could be determined.
