The state Commission on Judicial Conduct has admonished an upstate town justice for improperly issuing an eviction warrant and money judgment just one month after the disciplinary panel warned him about the same issue. Avon Village Justice Joseph Temperato, who is not a lawyer, in January 2012 issued a warrant of eviction and a money judgment against a tenant but neglected to have the notice of petition signed by an attorney, court clerk or judge as required under the Real Property Actions and Proceedings Law, according to a determination released yesterday. Rather, it was signed by the landlord’s agent.
