A divided state appeals panel has refused to overturn a jury’s finding that a man acted with “depraved indifference to human life” when he threw beer bottles from the 26th-floor balcony of his Manhattan hotel room, warranting a conviction for first-degree reckless endangerment and a year-long prison sentence.
