The state Court of Appeals will consider a motion for leave to appeal the second attempt of the Appellate Division, Second Department, to suspend Long Island attorney Peter Galasso for two years. Chief Judge Jonathan Lippman on Jan. 7 signed an order to show cause submitted by Galasso of Galasso, Langione, Catterson & LoFrumento in Garden City. Lippman also granted an interim stay of the suspension, which had been set to take effect on Jan. 22.

Galasso was initially suspended last February for allegedly faulty oversight of his brother, Anthony, the firm’s bookeeper, who embezzled millions of dollars. In response to Galasso’s appeal, the Court of Appeals affirmed most of the charges but sent the matter back to the Second Department to reconsider a finding that Galasso had not promptly complied with the disciplinary committee’s requests for information (NYLJ, Oct. 24, 2012). Last month, the Second Department reiterated that Galasso should be suspended for two years (NYLJ, Dec. 20).
