A magistrate judge in Buffalo is recommending full enforcement of a subpoena which would require Sterling Jewelers, the largest specialty jeweler in the country, to disclose in an ancillary case materials that could affect a much broader discrimination matter.

Although Magistrate Judge Jeremiah J. McCarthy in Equal Employment Opportunity Commission v. Sterling Jewelers, 11-mc-00028, did term “curious” the timing of the EEOC subpoena vis-à-vis the progress of discovery in the primary action, the court said the firm should reveal a report which allegedly shows it bars employees from discussing their pay with co-workers.
