ALBANY – The Court of Appeals wrestled yesterday with the question of whether a murder defendant, accused of killing his father and grievously injuring his mother, was properly accorded his Sixth Amendment right to confront his mother as a witness because she could not recall either the brutal attack or implicating her son to police hours afterward.
As she was being treated in her bedroom for injuries after the November 2004 attack, a detective asked Joan Porco, then 55, whether her son Christopher had attacked her.
