Defendants moved for a judgment not withstanding the verdict (NOV) or a directed verdict. Alternatively, they moved to set aside or reduce the verdict as excessive. The court stated that in determining there was sufficient evidence to support the verdict, it denied the motions for a directed verdict or judgment NOV, and also denied motions to set aside the verdict as not supported by the evidence and as excessive. The court found there was overwhelming evidence to justify the jury verdict. It stated the jury’s award of $3.12 million for past and future pain and suffering was amply justified. The court noted that in addition to the fibula and tibia fractures, plaintiff suffered from Reflex Sympathetic Dystrophy (RSD), noting one jury awarded $1.5 million for RSD alone, and another awarded $1.5 million for past and future pain and suffering for severe back injuries a decade ago.
