A Brooklyn judge has vacated a settlement agreement in a car-accident case on the basis of the defense’s mistaken assertion during settlement negotiations that the driver’s insurance policy carried a $25,000 limit, not a $250,000 limit.

Plaintiff Rotem Madar moved to vacate the settlement after his attorney learned about two years after the case was settled that a mistake had been made by an administrator hired by New York’s Insurance Company Liquidation Bureau.
