ALBANY – A divided Court of Appeals decided yesterday that a trial court properly allowed an elderly man who was too ill to travel to the Bronx to testify against his alleged attacker via a two-way video conference hookup from California.

In separate rulings yesterday, the Court also ruled that the beneficiary of a will did not violate its in terrorem clause by having the decedent’s ex-lawyer deposed to ask about the former wills he had drafted for the deceased and found that the state improperly withheld documents related to the controversial Columbia University expansion project into West Harlem.
