Arthur S. Greenspan, a partner at Richards Kibbe & Orbe, writes that the appointment of former DOJ prosecutor Robert Khuzami as director of the SEC and his public statements on requiring swiftness and urgency in his staff's work, procedural changes and the creation of specialized units at the SEC, and pressure on the SEC from external sources to be aggressive in its investigations combine to make this a propitious time for counsel at financial firms and public companies to consider their approach to dealing with an enforcement investigation.
