ALBANY – New York City is not liable for the injuries suffered by a special education teacher at the hands of a fourth-grader after the teacher had alerted her supervisors to the student’s violent tendencies and been advised to “hang in there,” the Court of Appeals ruled yesterday.

The Court threw out a $500,000 verdict against the city, ruling that Zelinda Antoinette Dinardo had not established that she had the required “special relationship” with the Board of Education upon which a finding of negligence could be based.
