Two sisters who claim they were seduced by their pastor can proceed with a suit against the church that employed him under a breach of fiduciary duty theory, a state judge has ruled.

The judge, Supreme Court Justice Thomas F. Whelan of Suffolk County (See Profile), also sanctioned Havkins Rosenfeld Ritzert & Varriale in Manhattan $10,000, for making a “frivolous” cross motion to dismiss on behalf of the church’s parent corporation in “bad faith…and without any reasonable basis in law and fact.”
