ALBANY – The loss of health insurance coverage is being added to state Domestic Relations Law as a factor that must be considered by New York courts as they determine the equitable distribution of marital property and maintenance awards during divorces.

The legislation signed by Governor David A. Paterson, A7570/S4533, represents the most significant alteration to the state equitable distribution and maintenance factors since their adoption in 1986, according to the bill’s chief Assembly sponsor, Helene Weinstein, D-Brooklyn. The change takes effect Sept. 21.
