Most practitioners should welcome the Convention, since the existing process is generally perceived as burdensome and lacking of clear standards. If the Convention becomes widely accepted, it will significantly impact whether parties in international business transactions choose arbitration or litigation to resolve their disputes, and how counsel should advise them.
