A state appeals panel divided sharply yesterday over the question of whether a suspect apprehended in a room where drugs were hidden could be charged with possessing the drugs. In the unsigned opinion, a three-judge Appellate Division, First Department, majority concluded that the facts surrounding the arrest were sufficient to create an inference that the defendant, Raheem Mayo, possessed 96 ziplock bags of cocaine hidden under a pair of men's jeans.
