At 7:20 p.m. on Monday, the New York Attorney General filed with the Appellate Division, First  Department, her memorandum of law opposing Donald Trump’s motion to stay enforcement of the $464.5 million judgment pending the determination of his appeal.

To recap the process: under CPLR § 5519 an appellant can automatically stay the enforcement of a judgment without a court order by posting a bond for the full amount of the judgment. In the alternative, the appellant can ask the Appellate Division to authorize a stay if he posts a bond for less than the full amount. Trump has asked to post a bond for $100 million to secure a stay.
