A Western New York appeals court could have New York City looking for a new place to bring hundreds of thousands of tons of its household trash and garbage.

The Appellate Division, Fourth Department is taking on the case, which involves a state constitutional amendment that guarantees New Yorkers’ right to clean and healthy air. The amendment has been leveraged in a lawsuit from a grassroots organization that says a privately operated landfill in Rochester is odorous and emits potent methane.
