Intended to address employee pay disparity based on protected characteristics, such as gender and race, states and cities across the country are passing and/or enacting pay disclosure or transparency laws. The requirements of these laws range from mandating employers disclose information, such as salary ranges, in job postings to providing salary ranges to applicants during the application process. At the forefront of the movement with current or impending laws are California; Colorado; Connecticut; Maryland; Nevada; Jersey City, New Jersey; New York State; Ithaca, New York; Rhode Island; and Washington. Beginning Nov. 1, 2022, New York City will join these ranks with its own law.

Among the challenges faced by employers of all sizes, across industries and locations, are:

• Risking losing out on much-needed and desired talent within their candidate pool and current workforce.
