This decision involved a petition to annul the respondents’ approval of a rezoning application which had been submitted by the respondent, New York Blood Center, Inc. (NYBC). The court denied the petition and granted the motion to dismiss which had been made by the respondents City of New York, NYC Dept., of City Planning, City Planning Commission and NYC Council (City).

The NYBC operates a “not-for-profit blood collection and distribution organization and a “research institute in the areas of epidemiology and data science.” It asserted that its current facilities were inadequate and it needed to replace its building with a new facility.
