An Albany appeals court held that the New York State Gaming Commission’s oversight of harness racing is proprietary, subjecting it to the ordinary rules of negligence.

The ruling by the Appellate Division, Third Department, stems from a competitor who filed a claim against the commission after he was seriously injured in the form of horse racing at the Saratoga Hotel and Casino racetrack in 2017.
