U.S. District Judge Gary Brown of the Eastern District of New York late Monday appeared skeptical of the standing of three landlords who have asked him to block New York’s revised COVID-19 eviction moratorium law as a violation of their right to due process.

The landlords, who have moved for a preliminary injunction through their attorneys at Gibson, Dunn & Crutcher, testified during a hearing lasting more than five hours that they have been emotionally and financially harmed by their inability to remove tenants from the properties they own.
