In a decision demonstrating the major new opening for obtaining police officer records in discovery following the repeal of New York Civil Rights Law Section 50-a, a state appeals court has ruled that New York City must produce internal records on a police officer who shot a fellow officer when a pit bull apparently charged at the officers, according to the decision and court records.
In a brief opinion, the Appellate Division, First Department court ruled that Manhattan Supreme Court Justice Francis Khan III, in a trial-level ruling, was correct in granting plaintiff Junmei Zhang’s motion for leave to renew and reargue his previously denied request to obtain personnel and disciplinary records in discovery on his fellow officer who shot him in the foot.
