Writing that it rejects the plaintiff’s attempt to turn Madison Square Garden “into insurers of the safety of spectators seated behind the plexiglass,” a state appeals court has dismissed a negligence action brought by a New York Rangers fan who was injured when a hockey puck flew into the stands and injured his hand as he shielded his son.

In a terse decision that credited an underlying trial-level opinion that addressed, in detail, the assumption-of-risk and duty-of-care issues before it, the Appellate Division, First Department wrote that “the Supreme Court, in its well-reasoned opinion, properly determined that defendants met their prima facie burden through sufficient proof that they satisfied the duty of care owed to plaintiff.”
