The U.S. Court of Appeals for the Second Circuit on Thursday revived claims that Energizer Holdings Inc. infringed trademarks for a competitor’s “Black Ice” car air fresheners with a similarly named product of its own.

A three-judge panel of the Manhattan-based appeals court pointed to evidence of bad faith in ruling that Energizer’s sale of its dual-scented “Midnight Black Ice Storm” fresheners had created a question of whether consumers would confuse the product with Car-Freshner Corp.’s Black Ice air freshener, which is sold under the popular Little Trees brand.
