An organization representing thousands of contractors has sued the state and the Metropolitan Transportation Authority over rules that aim to punish companies for delays and excessive costs on infrastructure projects.

The lawsuits, filed Monday in Manhattan state and federal courts, target a debarment statute that was “slipped into” the state budget bill in April. Under that law and related regulations, the MTA is obligated to bar a contractor from bidding on future contracts for a period of five years if it determines that the firm has failed to complete the project in a timely manner or if costs go over-budget by more than 10%.
