Kirkland & Ellis partner Paul Clement is expected to argue next month in a closely watched trio of U.S. Supreme Court cases that question whether workplace arbitration agreements that ban class actions violate federal labor laws. The former George W. Bush administration U.S. solicitor general was tapped to represent the three companies defending the bans. The companies and their lawyers involved were apparently at an impasse over which of their original high court lawyers should make the Oct. 2 arguments.

U.S. Attorney General Jeff Sessions overcame reluctance among top lawyers under his command and pushed forward last week in the U.S. Supreme Court to support a Colorado baker who refused on religious grounds to make a wedding cake for a same-sex couple, according to lawyers with knowledge of the U.S. Justice Department's decision. While it is rare for any U.S. attorney general to countermand the recommendation of the solicitor general, such an action is within the power of the office. The Justice Department disputed that there was any disagreement over the participation of the United States as a friend-of-the-court in the case.

The Trump administration delivered a new blow to the gay and lesbian community on Thursday when the U.S. Justice Department sided against a same-sex couple in a major discrimination case at the U.S. Supreme Court. The Justice Department filed a brief backing a Colorado baker who refused to bake a cake for a gay couple. "Weddings are sacred rites in the religious realm and profoundly symbolic ceremonies in the secular one," Jeffrey Wall, the acting U.S. solicitor general, wrote in the amicus brief.
