Litigators certainly have more of a swing in their step. As the credit crunch nears its first birthday, the theory is that those long-neglected contentious practices are about to have their moment in the sun.

It is an understandable sentiment, but one thing that should give pause is the hint of desperation emanating from litigators. Since the deal slump of 2002 and 2003 largely failed to deliver on its expected upswing, there has been a sense that litigators are living on borrowed time at top City law firms.
