It was the boom time in the late 80s and I decided to try my hand at a bigger firm. It was intimidating at first - every second person seemed to be public school and I thought I'd made a mistake. But I realised it was a lot more diverse, grew to love it and got involved in all sorts of interesting work. I haven't looked back."

    Trust & Estates Litigation Forum: Trust in business

    It is not often that a room full of litigators are likened to meek lambs. But Shan Warnock-Smith QC's description of how senior private client and family lawyers last year underestimated the impact of the financial turmoil was met with nods of agreement at this year's Trust and Estates Litigation Forum.As chair of the conference, Warnock-Smith described how the turn in the economy had had an unprecedented impact on trust and estates law, with negligence claims against advisers, trust disputes and insolvency all set to increase over the coming months.One of the key areas of discussion - both formally and informally - at the conference was the expected upturn in trust collapse and insolvency.Speaking at the conference, this year held at the Four Seasons resort at Terre Blanche, Provence, Carey Olsen pensions and trust partner Paul Buckle said: "It was not until comparatively recently that the idea of an insolvent trust was comparatively rare - with the possible exception of things such as certain types of pensions schemes and other trusts which may have been established to meet certain fixed liabilities."

    The halcyon days of unlimited cash to splash on boozy client lunches and blagging the day off to cut up turf at the golf course may have passed for the immediate future, but that doesn't mean clients don't still expect a little love now and again. But in leaner times, how should lawyers strike the balance between rewarding good business and cutting into profits?With every firm out to maximise the work available from existing clients, as well securing work from other people's clients, any cutbacks to marketing and entertainment budgets at this point have to be measured. And while showing clients you appreciate their business is one thing, decorum is required if you don't want them to start questioning whose bill their ostentatious gift was funded by.
