One of the judges who routinely decides whether potentially dangerous sex offenders should face post-prison confinement complained in a recent ruling that there is an “extraordinary lack of clarity” over rules governing such confinement proceedings.

Acting Manhattan Supreme Court Justice Daniel Conviser wrote that evolving expert opinion about antisocial personality disorder and other conditions, coupled with varying court interpretations about medical science and legal standards of evidence, have frustrated him as he looks for clear guidance in proceedings under Article 10 of the state Mental Hygiene Law.
