The School Board of Miami-Dade County, Florida announces the following Board Policy action will be taken at its meeting on:

To Amend Board Policies Board Policies 3120, Employment of Instructional Personnel; 1121.01, Employment Standards and Fingerprinting; and 3121.01, 4121.01, Employment Standards and Fingerprinting of all Employees, to conform to SB 676 (2023), HB 5101 (2023), and amendments to Florida Administrative Code ("F.A.C.") Rule 6A-4.004, Florida Educator’s Certificates with Academic, Administrative, Degreed Career and Technical, and Specialty Class Coverages. Policy 3120, Employment of Instructional Personnel, is proposed for amendment to the validity period of a nonrenewable, temporary teaching certificate from three (3) years to five (5) years. Policies 1121.01, Employment Standards and Fingerprinting, and 3121.01, 4121.01, Employment Standards and Fingerprinting of all Employees, are proposed for amendment to delineate disqualifying factors for employment and to clarify that beginning January 1, 2025, employee eligibility requirements will be within the purview of the Agency for Health Care Administration.

To Amend Board Policy 8405, School Safety, as a result of HB 543 (2023) redesignating threat assessment teams as threat management teams. Additionally, HB 543 includes the requirement that the Superintendent designate a Threat Management Coordinator and report the name and contact information of the Coordinator to the Office of Safe Schools. Additionally, at least one (1) member of the Threat Management Team must have personal familiarity with the student who is the subject of the threat assessment.

To Amend Board Policies 5200, Attendance, and 8330, Student Information, Records, and Privacy Rights, to conform to an amendment to Florida Administrative Code ("F.A.C.") 6A-1.0955 (Aug. 22, 2023). Policy 5200, Attendance, is proposed for amendment to clarify that a court order is required for a legal name change to be effectuated and that an assumed or alternate name can be added to DSIS and certain school documents upon signed, written request. Policy 8330, Student Information, Records, and Privacy Rights, is proposed for amendment to allow parents to specify the use of any deviation from their child’s legal name in school.

To Amend Board Policy 2431, Interscholastic Athletics, as a result of legislative updates. Board Policy 2431, Interscholastic Athletics, is proposed for amendment pursuant to HB 225 (2023), which amends F.S. 1006.15 to allow eligible students who participate in an interscholastic athletic activity to join another public school’s interscholastic athletic activity or a private school’s interscholastic activity if the activity is not offered by their public school. The policy is also revised to allow eligible students to continue participating in their current school’s interscholastic athletic activity after transferring to a new school, and to allow students of certain non-FHSAA private schools to join the District’s own interscholastic athletic activities.

To Amend Board Policy 6320, Purchasing, as a result of HB 3 (2023) and to align the policy language with current District practices. Board Policy 6320, Purchasing, proposed for amendment as a result of HB 3 (2023) which prohibits the Board from requesting documentation of, or providing preference based on, the vendor’s social, political, or ideological interests. Additionally, the Policy is recommended for revision to align with current District practices.

If requested, a hearing will be held during the October 11, 2023 School Board meeting. Persons requesting such a hearing must submit a written request to the Superintendent of Schools, Room 912, same address as above, by October 3, 2023. The policy will be effective upon filing with The School Board of Miami-Dade County, Florida on October 11, 2023. A person wishing to appeal any decision made by The School Board of Miami-Dade County, Florida, with respect to any action on this policy should ensure the preparation of a verbatim record of the proceedings, including the testimony and evidence upon which the appeal is to be based. Copies of the policy and the notice of intended action are available to the public for inspection and copying at cost in the Citizen Information Center, Room 102, 1450 N.E. Second Avenue, Miami, Florida.
