The School Board of Miami-Dade County, Florida announces the following Board Policy action will be taken at its meeting on:

To Amend Board Policy 2432, Driver Education, to include that the driver education program is designed for high school students who elect to participate in any of the available state approved driver education courses and that the purpose of the program is to introduce students to Florida driving laws/rules of the road and safe driving behavior. In addition, pursuant to the OIG Final Report of Investigation-Miami-Dade County Public Schools Driver Education Program; IG-17-0001- SI, amendments to the policy are proposed to ensure that any funds derived from the Miami-Dade County Driver’s Education Safety Trust Fund § 11-10 (2002) (County Ordinance No. 02-167) are utilized in conformity with the requirements of the Dori Slosberg Driver Education Safety Act, Section 318.1215, F.S., the operative grant award, and an ILA with the County for the use of such funds. Specifically, grant funds shall be used solely for enhancement of the District’s driver education program; funds shall be used for direct educational expenses and shall not be used for administrative/overhead expenses; the District shall provide a minimum of thirty percent (30%) behind-the-wheel experience; the District shall submit eligible expenditures to the County in accordance with the ILA; and the District shall offer driver education classes to private school students in accordance with the ILA. Additionally, the District shall allocate operable vehicles in an equitable manner to proportionately reflect the student population of the District, subject to the availability of driving ranges. The behind-the-wheel driver experience shall provide for the use of District adaptive vehicles and instructors or appropriate contracted services as permitted by law and the ILA.

To Amend Board Policy 5517.01, Bullying and Harassment, and document Policy Against Bullying and Harassment, incorporated by reference in the policy, to be clarified as follows: Definitions in the policy are aligned with the Code of Student Conduct and SESIR rule; Related Board policies and procedures regarding discrimination/harassment, complaints, reporting misconduct, and student transfers are cross referenced; Reference to Procedures for Promoting and Maintaining a Safe Learning Environment is deleted; Reporting and investigative procedures are clarified, including that pursuant to best practice investigative procedures, the school counselor or other school mental health services provider shall not investigate allegations of bullying/harassment; Updated data reporting for bullying, harassment, unsubstantiated harassment, sexual harassment, and threat/intimidation incidents, is outlined, to include whether the incident occurs physically or remotely, as well as to require that any bullying-related incidents that have as a basis, sex, race, disability, sexual orientation, or religion should include the incident basis, and the incident basis must also be noted in the student record of the victim; Districtauthorized bullying/harassment prevention programs are updated; Reference is made to Florida Statutes s. 1002.40 and Policy 5131, Student Transfers and Controlled Open Enrollment, to include that bullying and harassment are incidents that qualify a student for Hope Scholarship eligibility and parental notification must be made.

If requested, a Hearing will be held during the January 12, 2022 School Board meeting. Persons requesting such a hearing must submit a written request to the Superintendent of Schools, Room 912, same address as above, by December 15, 2021. The policy will be effective upon filing with The School Board of Miami-Dade County, Florida on January 12, 2022. A person wishing to appeal any decision made by The School Board of Miami-Dade County, Florida, with respect to any action on this policy should ensure the preparation of a verbatim record of the proceedings, including the testimony and evidence upon which the appeal is to be based. Copies of the policy and the notice of intended action are available to the public for inspection and copying at cost in the Citizen Information Center, Room 102, 1450 N.E. Second Avenue, Miami, Florida.
