The School Board of Miami-Dade County, Florida announces the following Board Policy action will be taken at its meeting on:

To Amend Board Policies 1140, Suspension or Dismissal of Administrators, 3140, Suspension or Dismissal of Instructional Staff, and 8141, Mandatory Reporting of Misconduct by Certificated Employee to include a statutory requirement under Section 1012.27(5)(b), F.S., that parents of a student who was subjected to or affected by alleged misconduct by instructional personnel or school administrators be notified of certain alleged misconduct.

To Amend Board Policies 1120.11, 3120.11, and 4120.11, Preference for Veterans in Employment, to clarify eligibility for veteran’s preference in employment under Section 295.07, F.S.

To Amend Board Policies 2260, Nondiscrimination and Access to Equal Educational Opportunity; 5517, Anti-Discrimination/Harassment(Students); 5517.02, Discrimination/Harassment Complaint Procedures for Students; and 5517.03, Dating Violence or Abuse to require that individuals conducting investigations under these policies retain all information as part of the investigation, including electronically stored information.

To Promulgate New Board Policy 8805, Religious Expression, to address student expression of religious viewpoints, religious clothing and accessories worn by students, student and employee engagement in religious activities, equal access to school facilities by religious student organizations, and student speakers in the public forum.

To Amend Board Policies 2270, Religion in the Curriculum, 5730, Equal Access for Non District-Sponsored Student Clubs and Activities, and 8800, Religious/Patriotic Ceremonies and Observances, to remove provisions that are duplicative or contradictory to provisions in new Policy 8805.

To Amend Board Policy 8810, The American Flag, to incorporate the new statutory mandate in Section 1003.44(4), F.S., that the official motto of the State of Florida be displayed in a conspicuous
place in all schools in the District and in each building used by the School Board. The policy is proposed to be renamed The American Flag and Official Motto of the State of Florida.

To Amend Board Policy 2215, Program of Instruction to incorporate the statutory requirement in 1003.42 (2) (s) and (t), F.S., requiring schools to include into the Character Development Program the values of the recipients of the Congressional Medal of honor and allow the course to be offered as a part of any schoolwide character building or veteran awareness initiatives.

To Amend Board Policy 2623, Student Assessment, to incorporate the statutory requirements in 1002.37(9)(b), 1002.395 (7)(e), 1008.23, and 1008.24(4)(a), F.S., requiring schools to ensure appropriate administration, participation and reporting of state-mandated assessments. The requirements include posting the testing calendar on the District’s website for parents and providing access to District testing facilities and dates of testing to eligible non-full time students. The amendment also allows decisions regarding permissible exemptions from statewide testing programs to be recommended by an IEP team for students with disabilities. Exemptions are subject to approval by the Superintendent.

To Amend Board Policy 5610, Suspension and Expulsion of Students, to reflect the District’s alternatives to outdoor suspension include Student Success Centers

To Amend Board Policy 9270, Home Education, to include the statutory revisions to the home education enrollment process in Section 1002.41, F.S.

To Amend Board Policy 9800, Charter Schools, to include statutory revisions in Section 1002.33, F.S. to the statutory charter application deadline, use of the state standard contract and District negotiation process, additional allowable deferrals for charter school opening, schools of hope establishment and contract process, Title I changes, capital outlay process changes, changes to the termination and non-renewal appeal processes, and other minor technical updates.

To Amend Board Policy 7310, Disposition of Surplus Property to include the statutory mandate in Section 1002.33(18)(e) that District facilities and tangible property that are identified as surplus, marked for disposal, or otherwise unused must be made available to charter schools on the same basis as they are made to other District schools.

To Amend Board Policy 0166, Non-Public Meetings, to establish in policy the Board’s existing statutory authority under Florida’s Sunshine law to hold meetings related to security system plans in private. These meetings are not required under Section 281.301, F.S., to be noticed and do not require that minutes be taken or released to the public. In addition, any documents and records relating to security system plans that are reviewed or discussed during the confidential meeting are exempt from disclosure under Section 119.07(3)(a), F.S.

To Amend Board Policy 5112, Entrance Requirements to add the new statutory requirement in Section 1006.07(1)(b), F.S., that upon enrollment in a public school, students must disclose any referrals to mental health services.

If requested a Hearing will be held during the April 17, 2019 School Board meeting. Persons requesting such a hearing must submit a written request to the Superintendent of Schools, Room 912, same address, by March 12, 2019. The policy will be effective upon filing with The School Board of Miami-Dade County, Florida on April 17, 2019. A person wishing to appeal any decision made by The School Board of Miami-Dade County, Florida, with respect to any action on this policy should ensure the preparation of a verbatim record of the proceedings, including the testimony and evidence upon which the appeal is to be based. Copies of the policy and the notice of intended action are available to the public for inspection and copying at cost in the Citizen Information Center, Room 102, 1450 N.E. Second Avenue, Miami, Florida.
