OU House, which operates a restaurant in Orlando, Florida, under the unregistered mark ‘Nine Spices Hotpot,’ sued Seaside Catering Management for trademark infringement on Nov. 7 in Florida Middle District Court. The suit, brought by Louis R. Gigliotti PA, accuses the defendant of opening a restaurant under the same name and wrongfully attempting to trademark the name despite the plaintiff’s senior use. Counsel have not yet appeared for the defendant. The case is 6:23-cv-02156, OU House Inc. v. Seaside Catering Management Inc.
