Florida’s Third District Court of Appeal entered an opinion Wednesday finding that property owners subject to compliance agreements with the City of Miami met their burden for a temporary injunction based on their equitable estoppel claims.

“The City has to act fairly when dealing with its residents and cannot draw a new line in the sand to accomplish illegal results for citizens who were properly complying with their requirements,” said Robert Zarco, a Zarco Einhorn Salkowski partner, who represents the plaintiffs, Tower Hotel LLC, Piedra Villas LLC, El Shopping LLC and Beatstik LLC against the defendant, the City of Miami.
