Florida’s First District Court of Appeal reversed a trial court’s judgment in favor of Baptist Hospital, finding unresolved factual issues regarding the hospital’s supervision and right of control over the emergency treating physicians.

The plaintiff, Latisha Gradia, was transported to Santa Rosa Medical Center after she went into cardiac arrest in 2021. However, due to her condition, Gradia was then transferred to Baptist Hospital in Pensacola, a Level II trauma center, for more appropriate care, according to the appellate court’s opinion filed Wednesday.
