The Schaghticoke Tribal Nation is claiming the state of Connecticut can’t use sovereign immunity to shield itself from a $610 million lawsuit for allegedly taking the tribe’s reservation land.

In its 45-page brief filed in Hartford Superior Court Monday opposing the state’s motion to dismiss, the tribe claimed its owed damages by the state for land taken over a period of time beginning more than two centuries ago. The nation claims it has standing to bring the suit because it’s recognized as a tribe by the state, and because sovereign immunity does not apply for the underlying Fifth Amendment claim.
