A federal judge in Connecticut refused to dismiss an HVAC company’s claim against its insurer, saying it’s too early in the case to determine whether the insurer has a duty to defend its customer.

The case involves a general contractor, the PAC Group and The Saybrook at Haddam. The PAC Group entered into a contract with County Wide Mechanical Services to install an HVAC system in the expansion of the Saybrook. After installation of the system, there were a series of component failures and malfunctions that resulted in a complete replacement of the unit.
