The Food and Drug Administration released a guidance on Wednesday, which if finalized, would ban retailers that do not have age-restricted areas of the store from selling flavored tobacco products for e-cigarettes.

The guidance makes an exception for tobacco, menthol- and mint-flavored products, which the FDA says there is still evidence showing that adults use those flavors to get away from smoking cigarettes. The FDA’s proposal also pushes up the deadline for companies to submit a premarket application to Aug. 8, 2021. The FDA had previously given manufacturers until Aug. 8, 2022, to submit a premarket application.
