After hearing oral arguments this week, the Massachusetts Supreme Judicial Court will decide whether a New England-based furniture retailer’s compensation plan for commissioned sales employees complied with its recent findings under the state wage acts in Sullivan v. Sleepy’s.

Counsel for Jordan’s Furniture appealed an $8.8 million judgment against it after the lower court found that the company violated the Massachusetts Overtime Statute, G. L. c. 151A, Section 1A, and the Wage Act, G. L. c 149, Sections 148 and 150, in an case brought by a former sales consultant, Matthew Sutton, on behalf of himself and nearly 250 other employees.
