The Massachusetts Supreme Judicial Court heard oral arguments Wednesday regarding whether a home health aide, who was terminated after declining to be vaccinated due to her religious beliefs, is owed unemployment benefits since she knowingly violated her employer’s COVID-19 vaccination policy as mandated by the state’s Executive Office of Health and Human Services.

During the argument session in Fallon Community Health Plan v. Division of Unemployment Assistance, several justices appeared wary of denying benefits to employees for expressing what appeared to be sincerely held religious beliefs.
