The Massachusetts Appellate Court reinstated an unfair business practices lawsuit against a Boston-area Fairfield Inn by Marriott, finding that the plaintiffs presented sufficient evidence to claim they were misled into making a reservation and scheduling meetings with prospective business clients before being removed for an undisclosed “no soliciting” policy.

The plaintiffs, Louise Connor, Stephanie Fishman, and their high-end children’s clothing business, NY Kids Showroom, planned to meet with prospective business clients at the Fairfield Inn Dedham, to showcase their clothing to customers in the Boston area. For their September 2019 stay, Fishman requested a late check-in, as well as a large suite, and discussed the handling of large boxes of samples that had been shipped to the hotel in advance, as they had done for several years at the same hotel, according to the opinion released March 18.
