Addressing a jurisdictional question of first impression, the U.S. Court of Appeals for the Tenth Circuit cited U.S. Supreme Court precedent in its 2-1 dismissal of an appeal which sought dismissal of a former employee’s Title XII allegations under a “ministerial exception.”
According to the opinion, Gregory Tucker is a former high school teacher and administrator/chaplain who was fired by Faith Christian Academy, a Bible-based Christian school. Tucker began teaching high school science at the school in 2000 and took on additional job duties as chaplain and Director of Student Life. In January of 2018, Tucker conducted a chapel meeting where he did a presentation on race and faith.
