The court of appeals granted in part and denied in part a petition for review of a decision of the Environmental Protection Agency. The court held that the Natural Resources Defense Council had Article III standing to challenge the Environmental Protection Agency’s conditional registration of two nanosilver-based pesticides. The court held further that the agency erred in finding no risk concern requiring mitigation for short- and intermediate-term aggregate exposure to textiles coated with the pesticides where one of its exposure scenarios reflected a margin of exposure that equaled the minimum required to find a risk concern under the agency’s own rules.
